These terms and conditions ("Terms of Service") govern your access to and use of the website ("Site") and the Application Programming Interfaces (“APIs”) offered by NetToolKit. By continuing to browse and use this Site and/or the APIs, you are agreeing to comply with and be bound by these Terms of Service.
All calls to our APIs require an API key. You agree to safeguard and monitor the use of all API keys associated with your account and you also agree that you are responsible for all use of your API keys, whether authorized or not.
To take advantage of some features of the Site and/or APIs, you might be required to create an account. If you create an account, you warrant that the information that you provide is accurate and truthful. You further agree to keep the information updated. If you are entering into this agreement on behalf of a company, you warrant that you have the authority to enter into the agreement on behalf of that company. You agree to notify NetToolKit immediately of any unauthorized use of your account or of any other breach in security that you are aware of. You may cancel your account but doing so does not entitle you to a refund of any payments made. We may delete an account that has no outstanding credits. We also reserve the right to terminate access to the Site and APIs for any reason; accounts that are terminated at our discretion are entitled to a refund of remaining active credits.
You may submit feedback (including corrections to our services) through the contact form and if you do, you agree that we may freely use your feedback or suggestions without any obligation to you. If you submit your e-mail address to the Site, you agree that we may contact you.
NetToolKit may, in its sole discretion, (i) restrict, suspend, or terminate your access to any or all of the Site and/or APIs; or (ii) cease to provide and maintain the Site, at any time, for any or no reason, with or without notice, and without liability. Upon doing so, we may retain or delete any information or content that you may have provided.
NetToolKit Geo Tile Server
Tiles provided by NetToolKit are based on OpenStreetMap data. Since use of the data is subject to OpenStreetMap’s Open Database License, use of our tiles requires attribution (see https://openlayers.org/en/latest/examples/attributions.html for an example). By using our tiles, you agree to comply with the terms of OpenStreetMap’s Open Database License.
Disclaimers and Limitation of Liability
THE SITE AND APIS ARE PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, WE EXPLICITLY DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE MAKE NO WARRANTY THAT THE SITE OR APIS WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS.
YOU ACKNOWLEDGE AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ENTIRE RISK ARISING OUT OF YOUR ACCESS TO AND USE OF THE SITE AND APIS REMAINS WITH YOU. WHERE ALLOWED BY LAW, IN NO EVENT WILL OUR AGGREGATE LIABILITY ARISING OUT OF USAGE THE SITE AND APIS WILL EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST 30 DAYS.
We may revise and update these Terms of Service at any time without notice. Your continued usage of the Site and APIs will mean you accept those changes.
If we do not enforce any right or provision of these Terms of Service, that does not constitute a waiver of future enforcement of that right or provision.
These Terms of Service will be governed by the laws of the State of California without regard to its conflict of laws provisions. The exclusive jurisdiction and venue of any action with respect to the subject matter of these Terms of Service will be the state and federal courts having jurisdiction over disputes arising in Santa Clara County, California, and each of the parties hereto waives any objection to jurisdiction and venue in such courts.
